Refunds - Cash or IOU

The CAA has issued a reminder to the travel industry of their responsibility to offer cash refunds due to the mass cancellations arising from the Middle East conflict.

This suggests some ATOL holders are side-stepping their obligations and offering vouchers (IOU’s) instead.

The CAA will have concerns the industry is stepping back towards Covid style Refund Credit Notes (RCN’s) - a time when most travel organisers offered these anti-consumer IOU’s in lieu of cash because they had already spent their customer’s money elsewhere.

This in turn forced the CAA to underwrite RCN’s for fear of widespread industry bankruptcy. To this day, it is certain that tens of millions pounds worth of RCN’s remain unclaimed by hoodwinked consumers.

The fact the CAA felt compelled to issue a reminder is a sad indictment of the lack of financial regulation within travel. It stands alone as the only major UK industry where customer pre-payments can be legally embezzled, far ahead of the services being taken.

Indeed, the 2024 Digital Markets, Competition and Consumers Act added blanket protection for all pre-payments with the exception of travel, mandating estate agents, funeral directors, bookmakers and others to safeguard customer pipeline money in Trust. Despite a series of devastating failures, the profligate travel industry was excluded. Why?
